§ 1 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Buchungen von Ferienunterkünften, die über die Websites spessart-escape.de bzw. spessart-escape.com oder per E-Mail/Telefon direkt mit dem Vermieter geschlossen werden.
Vermieter ist Julienne Höfel (nachfolgend „Gastgeber"), Gast ist die buchende natürliche Person (nachfolgend „Gast").
§ 2 Vertragsschluss
Mit dem Anklicken der Schaltfläche „Zahlungspflichtig buchen“ gibt der Gast ein verbindliches Angebot zum Abschluss eines Mietvertrages ab. Der Vertrag kommt mit der erfolgreichen Autorisierung der Kartenzahlung zustande — die Buchung wird sofort bestätigt, eine gesonderte Annahmeerklärung des Gastgebers ist nicht erforderlich.
Schlägt die Zahlung fehl, kommt kein Vertrag zustande und die Termine bleiben frei buchbar.
Die Bestätigung enthält alle wesentlichen Buchungsdetails: Anreise- und Abreisedatum, Gesamtpreis, Anzahl der Gäste und Anschrift des Mietobjekts. Buchbar sind maximal 4 Gäste und höchstens 28 aufeinanderfolgende Nächte.
§ 3 Preise und Zahlung

Übernachtungspreis
€ 75 pro Nacht (Standardtarif). Saisontarife können abweichen und werden in der Buchungsbestätigung ausgewiesen.

Endreinigungsgebühr
€ 25 einmalig pro Aufenthalt, im Gesamtpreis ausgewiesen. Bei einer Stornierung wird die Reinigungsgebühr im selben Verhältnis erstattet wie der übrige Betrag (siehe § 4).

Mindestaufenthalt
Kein Mindestaufenthalt — Buchungen sind ab einer Nacht möglich.
🧸
Zusatzbetten und Haustiere
Reisebett (0–3 Jahre) oder Zustellbett (4–6 Jahre) auf Anfrage: € 5 pro Kind und Nacht. Haustiere nach vorheriger Absprache gegen Gebühr. Diese Beträge sind nicht im online berechneten Gesamtpreis enthalten und werden vor Ort abgerechnet.
Zahlungsbedingungen
Der Gesamtbetrag ist bei der Buchung sofort und vollständig per Kreditkarte zu zahlen. Die Buchung kommt erst mit erfolgreicher Zahlung zustande; Sie erhalten unmittelbar danach eine Bestätigung. Es gibt keine Anzahlung und keine Restzahlung. Die Zahlungsabwicklung erfolgt über Stripe; wir speichern keine Kartendaten.
Erstattungen bei Stornierung richten sich nach § 4 und werden über dasselbe Zahlungsmittel zurückerstattet.
§ 4 Stornierungsbedingungen

Kostenlose Stornierung
Bis 7 Tage vor Anreise: 100 % des gezahlten Gesamtbetrags, einschließlich Reinigungsgebühr.

Teilerstattung
Bei Stornierung 3 bis 6 Tage vor Anreise: 50 % des gezahlten Gesamtbetrags.

Keine Erstattung
Bei Stornierung weniger als 3 Tage vor Anreise oder Nichterscheinen: keine Rückerstattung.
Jede Buchungsbestätigung enthält einen persönlichen Stornierungslink. Damit können Sie die Buchung jederzeit selbst stornieren; die Erstattung wird automatisch über Stripe auf dasselbe Zahlungsmittel ausgelöst und die Termine werden umgehend wieder freigegeben. Alternativ genügt eine E-Mail an spessartescape@gmx.de. Maßgeblich ist der Zeitpunkt des Storno-Eingangs; die Frist wird in ganzen Tagen bis zum Anreisetag berechnet.
§ 5 An- und Abreise / Check-in
Check-in: Zwischen 16:00 und 22:00 Uhr. Früherer oder späterer Check-in nach Absprache und Verfügbarkeit; bitte teilen Sie uns Ihre voraussichtliche Ankunftszeit vorab mit.
Check-out: Bis 11:00 Uhr. Später Check-out nach Absprache und gegen Aufpreis möglich.
Der Check-in erfolgt selbstständig (Self-Check-in). Zugangsinformationen werden nach vollständiger Zahlung spätestens 48 Stunden vor Anreise per E-Mail übermittelt.
§ 6 Hausordnung
- Maximale Belegung: 4 Personen. Nicht angemeldete Gäste sind nicht gestattet.
- Rauchen ist im gesamten Objekt verboten (auch Balkon/Terrasse).
- Haustiere sind nur nach vorheriger schriftlicher Absprache gestattet.
- Ruhezeiten: 22:00–07:00 Uhr. Partys und Veranstaltungen sind nicht gestattet.
- Das Objekt ist sorgsam zu behandeln. Schäden sind unverzüglich zu melden.
- Bei Abreise ist das Objekt besenrein zu hinterlassen (Geschirr gespült, Müll entsorgt).
§ 7 Haftung
Der Gastgeber haftet nicht für Schäden, die durch höhere Gewalt, Diebstahl, unvorhergesehene technische Defekte oder sonstige außerhalb seines Einflussbereichs liegende Ereignisse entstehen.
Der Gast haftet für alle Schäden, die durch ihn oder seine Begleitpersonen verursacht werden. Eine Kaution wird nicht erhoben — bei der Buchung wird ausschließlich der Gesamtpreis abgebucht und kein weiterer Betrag reserviert. Etwaige Schadensersatzansprüche werden gesondert geltend gemacht.
§ 8 Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland. Gerichtsstand ist — soweit gesetzlich zulässig — der Wohnort des Gastgebers.
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§ 1 Scope
These General Terms and Conditions (T&Cs) apply to all bookings of holiday accommodation made through the websites spessart-escape.de / spessart-escape.com or directly with the host by email or telephone.
The host is Julienne Höfel (hereinafter "Host"). The guest is the booking individual (hereinafter "Guest").
§ 2 Contract Formation
By clicking the “Book now and pay” button, the Guest makes a binding offer to enter into a rental agreement. The contract is concluded when the card payment is successfully authorised — the booking is confirmed immediately and no separate acceptance by the Host is required.
If payment fails, no contract is formed and the dates remain available.
The confirmation contains all key booking details: arrival and departure date, total price, number of guests, and address of the property. Bookings are limited to a maximum of 4 guests and 28 consecutive nights.
§ 3 Prices and Payment
Pricing Structure

Nightly Rate
€75 per night (standard rate). Seasonal rates may differ and will be stated in the booking confirmation.
🧹
Cleaning Fee
€25 one-time per stay, shown in the total price. On cancellation the cleaning fee is refunded in the same proportion as the rest of the amount (see § 4).
👥
Minimum Stay
No minimum stay — bookings are possible from one night.
🧸
Extra Beds and Pets
Cot (0–3 years) or extra bed (4–6 years) on request: €5 per child per night. Pets by prior arrangement for a fee. These amounts are not included in the total calculated online and are settled on site.
Payment Terms
The full amount is payable immediately at the time of booking by credit card. The booking is only concluded once payment succeeds; you receive confirmation straight away. There is no deposit and no balance payment. Payment is processed by Stripe; we do not store card details.
Refunds on cancellation follow § 4 and are returned to the same payment method.
§ 4 Cancellation Policy

Free Cancellation
Up to 7 days before arrival: 100% of the total amount paid, including the cleaning fee.

Partial Refund
Cancellation 3 to 6 days before arrival: 50% of the total amount paid.

No Refund
Cancellation less than 3 days before arrival or no-show: no refund.
Every booking confirmation contains a personal cancellation link. You can cancel yourself at any time; the refund is issued automatically via Stripe to the same payment method and the dates are released immediately. An email to spessartescape@gmx.de works too. The time the cancellation is received is decisive; the deadline is counted in whole days up to the arrival date.
§ 5 Arrival and Departure / Check-in
Check-in: Between 4:00 PM and 10:00 PM. Earlier or later check-in by arrangement and subject to availability; please tell us your expected arrival time in advance.
Check-out: By 11:00 AM. Late check-out by arrangement and may incur an additional charge.
Check-in is self-service (self-check-in). Access information will be sent by email after full payment, no later than 48 hours before arrival.
§ 6 House Rules
- Maximum occupancy: 4 persons. Unregistered guests are not permitted.
- Smoking is strictly prohibited throughout the property (including balcony/terrace).
- Pets are only permitted with prior written consent.
- Quiet hours: 10:00 PM – 7:00 AM. Parties and events are not permitted.
- The property must be treated with care. Any damage must be reported immediately.
- Upon departure, the property should be left in a tidy condition (dishes washed, bins emptied).
§ 7 Liability
The Host is not liable for damage caused by force majeure, theft, unforeseen technical defects, or other events beyond the Host's control.
The Guest is liable for all damage caused by themselves or their companions. No security deposit is taken — only the total price is charged at booking and no further amount is held. Any claims for damages are pursued separately.
§ 8 Final Provisions
German law applies. The place of jurisdiction is, to the extent permitted by law, the Host's place of residence.
Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions remains unaffected.
